PATILIVE USER AGREEMENT (TERMS OF USE)

1. PARTIES AND CONTACT INFORMATION

This User Agreement (“Agreement”) is entered into between the service provider identified below (“PatiLive” or the “Company”) and the natural person using the PatiLive mobile application (the “User”).

2. DEFINITIONS

• Application: The PatiLive mobile application.

• Services: All features offered through the Application, including QR pet tag, lost notice, and pet adoption functions.

• Content: Any and all content uploaded to or shared via the Application by the User, including text, photos, descriptions, listings, notices, comments, data, and similar materials.

• In-App Purchase (“IAP”): Monthly subscription and one-time purchase transactions offered via the App Store / Google Play.

3. SUBJECT MATTER AND SCOPE

3.1. This Agreement governs the rights and obligations of the parties regarding the download, installation, and use of the Application, the use of the Services, and IAP processes.

3.2. By using the Application or providing consent on the registration screen, the User declares that they have read, understood, and accepted this Agreement.

4. MEMBERSHIP, REGISTRATION, AND AGE REQUIREMENT

4.1. The User must be at least 18 years of age to benefit from the Application.

4.2. The User may register for the Application using e-mail, Sign in with Apple, or Sign in with Google (Gmail).

4.3. The User is responsible for ensuring that the information provided during registration is accurate, up to date, and complete. PatiLive shall not be liable for damages arising from inaccurate or incomplete information.

4.4. The User account is personal and may not be transferred to third parties. The User is solely responsible for ensuring account security (password, device security, etc.).

5. SERVICES PROVIDED

PatiLive provides the following Services through the Application:

• QR Pet Tag: Access to information associated with a pet tag and related functions.

• Lost Notice: Creation and management of lost/report notices.

• Pet Adoption: Creation, display, and management of adoption listings.

PatiLive may, at its sole discretion, improve or update the scope and operation of the Services, or temporarily or permanently discontinue certain features.

6. PRICING, IN-APP PURCHASES, AND REFUNDS

6.1. The Application may offer IAP options through monthly subscription and/or one-time purchase.

6.2. IAP transactions are carried out via the Apple App Store and/or Google Play Store. In this context:

• Payment infrastructure, invoicing, and collection processes are subject to the rules of the relevant store.

• Subscription initiation, renewal, cancellation, and refund processes are handled in accordance with the procedures of the relevant store.

6.3. Refunds: The User shall submit refund requests through the App Store / Google Play Store in accordance with the applicable store policies. PatiLive is not responsible for refund decisions or processes carried out by the stores.

7. USER OBLIGATIONS

The User accepts, declares, and undertakes that they shall:

• use the Application in compliance with the law and this Agreement,

• respect the rights of others (including personal rights, copyrights, trademark rights, and privacy),

• not misuse the content and functions within the Application,

• refrain from any conduct that may compromise Application security.

8. PROHIBITED CONDUCT AND SANCTIONS

8.1. The following conduct is strictly prohibited:

• Creating false reports / false lost notices,

• Sharing or promoting content involving harm to animals,

• Spamming (repeated listings, deceptive redirections, etc.),

• Sharing content involving insults, hate speech, harassment, or violations of personal rights,

• Fraudulent or deceptive conduct,

• Unlawful content and activities.

8.2. Sanctions: In the event of a detected violation, PatiLive has the right, depending on the nature of the violation, to remove content, suspend the account, and/or permanently close the account.

8.3. PatiLive may retain records and any evidence it deems necessary in relation to violations and may share them with competent authorities.

9. CONTENT, MODERATION, AND LICENSES

9.1. The User acknowledges that the Content uploaded to the Application is lawful and that the User holds all necessary permissions.

9.2. The User acknowledges granting PatiLive a worldwide, royalty-free, non-transferable license to use the Content for the purposes of operating the Application, providing the Services, displaying the Content within the Application, and processing it technically.

9.3. Without any obligation to make editorial changes to Content, PatiLive may remove Content that is unlawful, misleading, harmful, or in breach of this Agreement.

10. INTELLECTUAL PROPERTY

The software, design, trademark/domain name, texts, and all elements of the Application belong to PatiLive and/or its licensors. The User is granted only a limited and revocable right of use under this Agreement.

11. LIMITATION OF LIABILITY

11.1. PatiLive does not warrant that the Application will operate uninterruptedly or error-free.

11.2. To the extent permitted by applicable law, PatiLive limits its liability for indirect damages, data loss, loss of profit, loss of reputation, and similar damages that may arise during the User’s use of the Application.

11.3. The User is responsible for the accuracy and lawfulness of Content shared by the User.

12. TERM, TERMINATION, AND ACCOUNT CLOSURE

12.1. This Agreement enters into force when accepted by the User and remains in effect for as long as the User uses the Application.

12.2. PatiLive may suspend or close the User’s account in cases of breach of this Agreement, unlawfulness, or security risk.

12.3. Account Deletion / Closure:
The User may delete their account instantly by using the Delete My Account function within the Application.

• Once account deletion is completed, the User account is closed and access to the Application is no longer possible.

• Records required to be retained under applicable law (e.g., legal obligations, dispute/audit processes) may be preserved for the relevant statutory retention periods.

13. PERSONAL DATA AND PRIVACY

13.1. The User’s personal data is processed in accordance with applicable legislation and the PatiLive Privacy Policy.

13.2. By using the Application, the User also acknowledges that they have read and understood the Privacy Policy.

14. AMENDMENTS TO THE AGREEMENT

PatiLive may update this Agreement at any time. Updates become effective on the date they are published within the Application or notified to the User. Continued use of the Application by the User constitutes acceptance of such updates.

15. GOVERNING LAW AND JURISDICTION

15.1. This Agreement is governed by the laws of the Republic of Türkiye.

15.2. To the extent permitted by applicable law, the Courts and Enforcement Offices of Fethiye (Muğla) shall have jurisdiction over disputes.
In consumer transactions, the User’s statutory rights of application and recourse are reserved.

16. ENTRY INTO FORCE

This Agreement enters into force when the User gives consent on the registration screen.
